Hereinafter, the platform shall be referred to as Wind Solar Market and CONSULTRIO SRL as the Website Operator. Wind Solar Market y CONSULTRIO SRL, The headline.
Accessing or using the website implies acceptance of these Terms to the extent that they apply. To register, publish projects, request confidential information or contract services, the user must expressly accept the Terms in force at that time.
2. Purpose of the platform
Wind Solar Market is a digital platform designed to facilitate:
- the submission of solar and wind energy projects;
- the search for renewable projects;
- contact between owners, developers, buyers, investors, financiers and potential strategic partners;
- the initial exchange of information between interested parties;
- the international promotion of opportunities relating to renewable projects.
The platform does not guarantee that contacts initiated through the website will result in negotiation, investment, sale, financing, or any other transaction.
3. Nature of the service
Unless expressly agreed otherwise by means of a separate contract, Wind Solar Market acts solely as an information, introduction and contact platform.
Wind Solar Market
- is not the owner of the projects published by third parties;
- does not buy or sell the projects directly;
- does not automatically represent sellers, buyers or investors;
- does not act as a financial entity, crowdfunding platform, investment services firm or securities intermediary;
- does not receive, hold or transfer funds intended for operations;
- does not execute investment orders;
- does not guarantee funding, profitability, energy production or economic return;
- does not provide personalised financial, tax, legal or technical advice merely through the use of the platform;
- it does not form part of any contracts that may be entered into between users.
Any additional professional services offered by the Proprietor shall be subject to a separate proposal or contract.
4. Platform users
The platform is aimed at private individuals as well as companies, professionals, developers, project owners, investors and authorised representatives of companies.
To register, the user must:
- be at least 18 years old;
- to have sufficient legal capacity;
- provide accurate, complete and up-to-date information;
- act on one's own behalf or have sufficient authorisation to represent a legal entity or a third party;
- accept these Conditions and the Privacy Policy.
The Data Controller may request additional documents or information to verify the identity, capacity or representation of the user.
5. Registration and user account
Certain functions require the creation of an account.
The user is responsible for:
- provide correct and up-to-date data;
- protect your password and credentials;
- do not share your account with unauthorised people;
- report any misuse or unauthorised access;
- keep your email address up to date;
- to be held accountable for any actions carried out via your account where these are attributable to your conduct.
Each account is personal. It may not be sold, assigned or transferred without the account holder’s authorisation.

6. Publication of projects
Authorised users may submit solar or wind power projects for potential publication.
The submission of a project does not imply its automatic publication. Wind Solar Market may previously review the information, request clarifications or documentation and decide whether the project meets the minimum conditions of the platform.
The user who publishes or submits a project declares that:
- is authorised to submit the project;
- the information provided is accurate and not misleading;
- you have sufficient rights regarding the texts, photographs and documents provided;
- the publication does not breach obligations of confidentiality;
- does not impersonate any person, company or owner;
- the technical and administrative data reasonably reflect the known status of the project;
- it shall report substantial changes, suspension, sale or withdrawal of the project;
- it shall not deliberately conceal any encumbrances, litigation, impediments or relevant circumstances.
The publication does not constitute a certification, legal validation, audit, appraisal or due diligence carried out by Wind Solar Market.
Review and moderation
Wind Solar Market will be able to:
- review the content before or after publishing it;
- correct purely formal or presentation errors;
- request supporting documentation;
- temporarily restrict the visibility of a project;
- to reject, suspend or withdraw a publication;
- block documents that may contain sensitive information;
- restrict access to restricted content;
- request the deletion of unnecessary personal data;
- take measures to protect users and the platform.
The review carried out by Wind Solar Market does not replace the checks that prospective buyers, investors or advisers should carry out.
Where a significant action is taken in relation to an account or a post, the Account Holder shall endeavour to inform the user concerned and explain the reason, unless legislation, security or fraud prevention considerations dictate otherwise.
8. Prohibited content
It is not permitted to publish, transmit or use the platform for content that:
- are false, misleading or fraudulent;
- are unlawful or promote unlawful activity;
- infringe intellectual or industrial property rights;
- breach confidentiality obligations;
- contain personal data relating to third parties without a legitimate basis;
- impersonate another person or company;
- contain viruses, malicious code or unauthorised access mechanisms;
- are discriminatory, threatening or seriously offensive;
- attempt to manipulate, damage or overload the platform;
- constitute unsolicited advertising or mass data collection;
- present a return or result as guaranteed when it is not;
- might lead one to believe that Wind Solar Market endorses, certifies or guarantees the project;
- breach these conditions or third-party rights.
9. Notification of illicit or incorrect content
Anyone may report the potential existence of illicit, fraudulent, inaccurate or contrary content to these Terms through:

The communication must identify, as far as possible:
- the affected content or project;
- their location within the platform;
- the reason for the complaint;
- the supporting documentation or explanation;
- the contact details of the person submitting the communication.
Wind Solar Market will examine communications made in good faith and may request additional information, maintain the content, limit it, correct it, suspend it or withdraw it.
The abusive or deliberately false presentation of claims may result in access restrictions.
10. Reserved information and confidentiality
Certain documents or data may be available exclusively to registered or authorised users.
Access to reserved information does not grant the user the right to:
- publish it or distribute it freely;
- use it for purposes other than the evaluation of a potential transaction;
- contacting third parties identified in the documents outside the authorised purpose;
- reproduce databases or project listings;
- circumvent technical access restrictions;
- disclosing trade secrets or confidential information.
Where a transaction requires a higher level of confidentiality, the parties must enter into a separate confidentiality agreement.
Wind Solar Market may withdraw access from any user who improperly uses confidential information.
11. Audits and independent advice
Before making a decision, the user must carry out their own checks and obtain independent professional advice.
Among other things, you should check:
- the identity and capacity of the parties;
- the ownership and representation of the project;
- land rights;
- the licences and authorisations;
- the stage of development;
- network connectivity and capacity;
- the technical and environmental studies;
- the production estimates;
- the existing contracts;
- liabilities and legal disputes;
- the company’s corporate, tax and financial situation;
- technical and economic feasibility;
- the financing conditions;
- the legal and tax consequences of the transaction.
No information on the platform should be considered in itself sufficient to adopt an investment, purchase or financing decision.
12. Prices and paid services
General access to certain parts of the website may be free of charge.
Publication, promotion, featured visibility, access to restricted documentation, subscriptions or other features may be subject to fees or payment plans.
Before taking out a paid service, the user will be clearly informed about:
- the service features;
- the total price and any applicable taxes;
- the method and frequency of payment;
- the duration;
- whether or not there is automatic renewal;
- the cancellation conditions;
- any relevant restrictions.
The contracting process will not be completed until the user carries out the corresponding confirmation action.
Publishing a project during a free period does not guarantee that the free status will be maintained indefinitely. New rates will not be applied retroactively to services already contracted, except with express acceptance or where legally permitted.
13. Consumers and right of withdrawal
Where the user is legally considered a consumer and enters into a distance contract for a paid service, they shall enjoy the rights recognised by the applicable regulations.
Where applicable, the consumer shall have a period of fourteen calendar days to withdraw from the contract, without needing to justify their decision.
If you expressly request that the provision of the service begins during that period, you may be required to pay an amount proportional to the service actually provided up to the date of cancellation.
When a digital service has been fully performed before the expiry of the cancellation period, the loss of that right shall only occur when the legally required conditions are met, including the express consent of the consumer where necessary.
Specific information regarding withdrawal, cancellation and refunds will be provided prior to each paid purchase.
14. Intellectual and industrial property
The design, logo, graphic identity, structure, proprietary text, databases and other elements created for Wind Solar Market belong to the Owner or are used with authorisation.
The user will not be able to:
- to copy or substantially reproduce the platform;
- systematically extract their databases;
- use unauthorised robots or automated tools;
- modify or remove proprietary notices and labels;
- using the name or logo of Wind Solar Market without permission;
- create a derivative platform using its content or structure.
The user retains all rights to the content they have contributed.
By submitting content for publication, you grant Wind Solar Market a non-exclusive, revocable and limited licence to store, adapt, translate, display and communicate such content to the extent necessary to provide and promote the service.
The user may request the removal of their project, without prejudice to any legal obligations regarding retention and the copies required for security, evidence or regulatory compliance.
15. Data protection
Personal data will be processed in accordance with the Privacy Policy.
The user who provides personal data of third parties declares that they have a lawful basis for doing so and that they have appropriately informed the data subjects where necessary.
Published documents must not contain any unnecessary personal data, handwritten signatures, identification numbers, home addresses or other sensitive information that is not strictly necessary.
Wind Solar Market may hide or delete such data to protect the individuals concerned.
16. Availability and security
Wind Solar Market will endeavour to keep the platform available and secure, but does not guarantee that it will operate without interruption or be free from errors.
The service may be temporarily suspended due to:
- maintenance;
- updates;
- technical faults;
- security incidents;
- cases of force majeure;
- actions of technology suppliers;
- necessary measures to protect users.
The user must keep their own copies of the information and documentation they submit. The platform must not be used as the sole archiving or document retention system.
17. Liability
Each user is responsible for the information they provide, publish or communicate.
To the extent permitted by applicable law, Wind Solar Market shall not be liable for:
- the accuracy of the information provided by third parties;
- decisions regarding purchasing, selling, investing or financing;
- economic, technical or administrative results;
- negotiations or contracts between users;
- breaches by the parties;
- loss of opportunities or expectations;
- errors in production or profitability estimates;
- regulatory, administrative or market changes;
- temporary interruptions;
- unauthorised use of credentials attributable to the user;
- external links or services;
- documentation withdrawn or amended by the person who provided it.
Nothing in these Terms and Conditions excludes or limits any liability that cannot be lawfully excluded, in particular the inalienable rights of consumers.
18. Suspension and cancellation of accounts
Wind Solar Market may warn, limit, suspend or cancel an account when:
- these Conditions are breached;
- false data are provided;
- there is reasonable evidence of fraud;
- third-party rights are infringed;
- reserved information is used improperly;
- the security of the platform is compromised;
- there is a legal obligation or requirement from an authority;
- the account remains inactive for a prolonged period;
- the user makes abusive or harmful use.
The measure taken will be proportionate to the seriousness and frequency of the conduct, provided that circumstances permit.
The user may request the cancellation of their account via the contact email address. The cancellation shall not affect any responsibilities or obligations incurred previously.
19. Third-party links and services
The platform may contain links to external pages or services.
Wind Solar Market does not control or guarantee:
- their availability;
- your security;
- its contents;
- its privacy policy;
- its terms and conditions;
- the accuracy of the information provided.
Access to such services is at the user's own risk.
20. Electronic communications
The user agrees that communications relating to their account, projects, requests, security or services may be sent by email or via in-platform notices.
Users must ensure they have a valid email address and check their emails.
Commercial communications will only be sent when there is a sufficient legal basis and they may be cancelled using the mechanisms provided.
21. Amendments to the Terms and Conditions
Wind Solar Market may amend these Terms and Conditions to bring them into line with:
- legislative changes;
- new features;
- payment systems;
- new services;
- security measures;
- changes to the business model;
- operational requirements.
When a modification significantly affects registered users or contracted services, notice will be given a reasonable time in advance where possible.
Continued use of the platform after the new Terms and Conditions come into force will constitute acceptance of them where legally applicable. If the user does not agree, they may stop using the service and request the closure of their account.
22. Legislation and jurisdiction
These Terms and Conditions are governed by Romanian law and by any applicable European Union legislation.
Where the user acts as a consumer, they shall retain the protection afforded to them by the mandatory rules applicable in their country of residence and may bring proceedings before the competent courts in accordance with consumer protection legislation.
Where the user is acting as a business or a professional, and where permitted by law, any dispute shall be submitted to the competent courts of Cluj-Napoca, Romania.

24. Severability
Should any clause be declared null and void, invalid or unenforceable, the remaining provisions shall remain valid.
The affected clause shall be interpreted or replaced, to the extent legally possible, with one that preserves an equivalent purpose.
25. Applicable version
The current version shall be that published on the website at the relevant time.
